看牙發現疑罹癌　保險不賠

王姓男子2010年向國泰人壽投保壽險300萬元，2年後因舌癌過世，王男家人要求理賠，國泰認為，王男在投保前1年看牙醫時，牙醫告知他舌有白斑，建議去大醫院檢查，但他投保時沒說這些，最高法院認定他違反投保告知義務，判國泰不用賠確定。

本案一審高雄地院認定，王男看牙醫時，無法判斷舌白斑可能是癌症，也不知牙醫告訴他舌有白斑是投保應告知事項，判國泰應理賠，國泰上訴後，二審高等法院高雄分院不認同一審看法，認為這是投保時應主動告知事項，且王男投保後2個月曾因舌頭流血至醫院就診，顯見他向國泰投保時，應已知舌頭有問題，卻未告知保險公司，還分別向國泰等3保險公司密集投保700萬元，改判國泰免賠，王家上訴後，最高法院駁回。（劉志原╱台北報導）
