開砂石車衝撞總統府的41歲男子張德正，昨(30日)因二度獲釋，檢方不服再提出抗告，今日(31日)抗告成功，目前正召開羈押庭中，他的胞兄也表示對於可能「三進三出」覺得誇張。

張德正25日涉開貨車衝撞總統府，檢方昨天抗告失敗，北院二度駁回羈押聲請，仍認為張德正的健康狀況沒逃亡之虞，將他責付3名辯護律師。

對於北院二度駁回羈押聲請，高院清晨再度發回更審。高院認為北院沒說明張德正有高度再犯殺人重罪危險性，也沒說明責付給3名律師的理由。張德正的律師表示，張德正目前仍需坐輪椅，不可能有逃亡的能力，而且若被羈押， 對於張德正的傷勢有很大影響。他也表示這案子考驗台灣是否是成熟法治國家。預防性羈押要有特定罪名，不能擴張解釋、類推適用作為羈押理由，這將對台灣法治造成重大傷害。

北院今日(31日)下午3時再開羈押庭，張德正在哥哥的陪同下到台北地院。

25日凌晨5時，張德正涉嫌開砂石車衝撞總統府，最後卡在防彈鋼門，而他當時受猛力撞擊而昏倒送往台大醫院急救。
